Purposes and legal basis of data processing:

The purpose of the video recording is to carry out a research project to safeguard and improve automated driving. The recordings are anonymised after recording.

The legal basis for data collection and data storage for the aforementioned research purposes is Art. 6 para. 1 lit. e GDPR in conjunction with Art. 2 para. 1 BayHSchG in conjunction with. Art. 25 BayDSG, as well as Art. 9 para. 2 lit. j GDPR in conjunction with Art. Art. 8 para. 1 no. 5 BayDSG in conjunction with Art. Art. 6 para. 2 no. 3 lit. c BayDSG for special categories of data.

Storage duration or criteria for determining the duration:

The video recordings from each camera are anonymised immediately in accordance with the state of the art. The maximum permitted storage period for the raw data is 30 minutes.

Recipients or categories of recipients of the data:

Only data that does not contain any personal reference is passed on or published.

Information on the rights of data subjects

The data subject has the right to obtain from the controller confirmation as to whether or not personal data concerning him or her are being processed, and, where that is the case, access to the personal data and the information specified in Art. 15 GDPR.

The data subject has the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning him or her and, where applicable, the completion of incomplete personal data (Art. 16 GDPR).

The data subject has the right to obtain from the controller the erasure of personal data concerning him or her without undue delay where one of the grounds listed in Art. 17 GDPR applies, e.g. if the data is no longer required for the purposes pursued(right to erasure).

The data subject has the right to obtain from the controller restriction of processing where one of the conditions listed in Art. 18 GDPR applies, e.g. if the data subject has objected to processing, for the duration of the verification by the controller.

The data subject has the right to object, on grounds relating to his or her particular situation, at any time to processing of personal data concerning him or her. The controller will then no longer process the personal data unless the controller demonstrates compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims (Art. 21 GDPR).

Without prejudice to any other administrative or judicial remedy, every data subject has the right to lodge a complaint with a supervisory authority if the data subject considers that the processing of personal data relating to him or her infringes the GDPR (Art. 77 GDPR). The supervisory authority responsible for us is the Bavarian State Commissioner for Data Protection, Postfach 22 12 29, 80502 Munich, Germany, in accordance with Art. 15 BayDSG.
